Terms of Service

1. Services Offered
1.1 – Terrascapes Land Care provides the following services: mowing, edging, trimming, hedging, weed control, and blowing. Additional services may be available upon request.
2. Service Area
2.1 – Terrascapes Land Care offers services within Sonoma County and surrounding areas.
3. Payment Terms
3.1 – Accepted Payment Methods: credit/debit cards, Apple Pay, Google Pay, ACH transfers, and checks.
3.2 – Residential Clients must keep a card on file with Autopay enabled before any service begins and until the final invoice is processed. Exceptions may be granted for check payments (case by case).
3.3 – Commercial Clients may pay by card or check with prior approval.
3.4 – All payments are due within 7 days of issuance. If not paid within 7 days, late fees begin to be applied automatically.
3.5 – Late Fees apply as follows:
20% after 7 days
30% after 14 days
40% after 30 days (+ possible collections)
For each 30 days past due, an additional 30% fee is added and legal steps may begin.
3.6 – Card on File & Autopay Authorization
By providing a credit/debit card or other payment method and authorizing Autopay, the Client authorizes Terrascapes Land Care to securely store the payment method on file and to charge it automatically for invoices issued for scheduled services, completed services, and any approved additional work.
3.7 – Timing of Charges
Charges may be processed on the invoice date, on the service date, or within a reasonable period after completion of services unless otherwise agreed in writing.
3.8 – Receipts & Notifications
Clients will receive an invoice and/or payment confirmation by email or through the Client Portal for each transaction.
3.9 – Failed Payments
If a payment attempt is declined, Terrascapes Land Care may pause service until payment is successfully processed. The Client remains responsible for all amounts due, including any applicable late fees and bank/processing fees charged to Terrascapes Land Care.
3.10 – Updating Payment Information
The Client is responsible for maintaining a valid payment method on file and updating billing information promptly to avoid payment interruptions.
3.11 – Disputed Charges
Clients must notify Terrascapes Land Care of any billing disputes within 7 days of the invoice date. Failure to notify within this period constitutes acceptance of the charge, except as otherwise required by law.
4. Cancellation Policy
4.1 – A minimum of 24 hours’ notice is required to cancel a service without penalty.
Cancellations made with less than 24 hours’ notice incur a fee equal to 50% of the service price.
5. Liability
5.1 – Terrascapes Land Care will exercise reasonable care in performing services but is not liable for any indirect, incidental, or consequential damages arising from service performance.
5.2 – Liability is limited to the cost of the service performed on the day of service. Any claim must be made within 48 hours of service and must comply with Section 6.
6. Completion, Acceptance & Touch-Up Period
6.1 – Definition of Completion “Completion” occurs when Terrascapes Land Care’s crew has finished the agreed-upon work and has left the job site.
6.2 – Notice Requirement Client has 48 hours from Completion to inspect the work and submit written notice (email: contact@TLC707.com / portal request) of any defects or touch-up requests through the Client Portal or by email.
6.3 – Repairs During Notice Period Terrascapes Land Care may return once at no additional cost to correct deficiencies reasonably attributable to its work and reported within 48 hours.
6.4 – Acceptance & Waiver Failure to provide notice within 48 hours constitutes final acceptance of the work and waives any claim for correction.
6.5 – Natural Wear & Exclusions Terrascapes Land Care is not liable for wear or changes caused by weather, plant growth or decline, soil movement, pests, erosion, or other natural factors.
6.6 – Cross-Reference All claims related to work quality or completion must comply with the notice requirements and deadlines of this Section.
7. Touch-Up / Warranty on Lawn Care Services
7.1 – Scope and Duration
Terrascapes Land Care warrants that lawn care services (including mowing, fertilizing, weed control, edging, and related maintenance) will be performed in a competent, workmanlike manner. Any defects or issues from deficient performance (such as bare patches, improper edging, or misapplication) must be reported to Terrascapes Land Care within 48hrs of the last service date.
7.2 – Notice and Inspection
Client must submit written notice (by email or portal request) detailing the specific issue, location, and photos if possible. Terrascapes Land Care reserves the right to inspect the area before performing any remedial work.
7.3 – Remedy / Touch-Ups
If Terrascapes Land Care determines the issue results from its own workmanship error (and not client neglect, weather extremes, pests, disease, irrigation failure, or other external causes), Terrascapes Land Care will perform one corrective service visit at no additional charge.
7.4 – Limitations and Exclusions
This warranty does not cover issues caused by:
the client (e.g., over-mowing, under-watering, chemical damage)
acts of nature (drought, flooding, extreme temperatures, etc.)
pest or disease infestations
irrigation malfunctions beyond Terrascapes Land Care’s control
damage by third parties
Additional touch-ups beyond one reasonable revisit will be billed at the standard service rate.
7.5 – Cap on Liability
Terrascapes Land Care’s total liability under this warranty shall not exceed the amount paid by the client for the specific service that caused the deficiency.
7.6 – Time Limit / Expiration
This warranty expires 48 hours after the service date. After that period, any remedial work will be considered a new service and billed accordingly.
8. Changes to Services
Clients may request service changes via the Client Portal or email. Additional charges may apply for changes or added services.
9. Termination of Services
A 30-day notice is required to terminate services without penalty. If not provided, Terrascapes Land Care may charge all amounts owed plus a 25% termination fee.
10. Access
Client must allow free access to work areas and provide space for materials and debris. Driveways should remain clear for vehicle movement during work hours. Terrascapes Land Care will take reasonable measures to protect property and vegetation.
11. Rate Increase
Terrascapes Land Care reserves the right to adjust service fees at any time to reflect increases in labor, materials, or operational costs with or without notice.
12. Hourly Work
Hourly work is billed per man hour (per worker, per hour). For some projects with variable completion times, totals will be calculated upon completion and added to the final invoice.
13. Governing Law
These terms and conditions are governed by the laws of the State of California.
14. Dispute Resolution & Mediation Requirement
14.1 – Good-Faith Resolution
The Client and Terrascapes Land Care agree to make every reasonable effort to resolve any dispute or disagreement through open communication and good-faith discussion before pursuing any legal remedy.
14.2 – Mediation Requirement
If a dispute cannot be resolved informally, both parties agree to participate in non-binding mediation conducted by a neutral third-party mediator located in Sonoma County, California (or another mutually agreed location). The cost of mediation shall be shared equally by both parties.
14.3 – No Lawsuits or Court Actions Without Mediation
The Client agrees not to initiate any lawsuit, arbitration, or court proceeding against Terrascapes Land Care unless mediation has first been attempted in good faith.
14.4 – Limitation on Damages
In any dispute, Terrascapes Land Care’s total liability shall not exceed the total amount paid by the Client for the specific services giving rise to the claim. Under no circumstances shall Terrascapes Land Care be liable for incidental, consequential, or punitive damages.
14.5 – Governing Venue
Any legal action permitted under this Agreement shall be filed and conducted exclusively in the courts of Sonoma County, California, and governed by the laws of the State of California.
15. Amendments
Terrascapes Land Care reserves the right to amend these terms and conditions at any time with or without notice. Clients are responsible for checking for updates. A current link to these terms will be included in all invoices and estimates for easy access.
